Acceptance of Terms

By accessing or using the services provided by mythicerwt B.V. ("mythicerwt," "we," "our," or "us"), including our website at mythicerwt.top and our food delivery services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.

These Terms constitute a legally binding agreement between you and mythicerwt B.V., a company registered in the Netherlands with registration number 73840961, having its registered office at Molenweg 188, 1352 FI Almere, Netherlands.

Description of Services

mythicerwt operates a food delivery service that connects customers with quality meal options. Our services include individual meal delivery, family packages, and event catering services throughout Almere and surrounding areas in the Netherlands.

We reserve the right to modify, suspend, or discontinue any aspect of our services at any time with or without notice. We may also impose limits on certain features or restrict access to parts or all of our services without notice or liability.

User Obligations

When using our services, you agree to:

• Provide accurate, current, and complete information when placing orders
• Maintain the confidentiality of your account credentials
• Use our services only for lawful purposes
• Respect the rights of mythicerwt and other users
• Comply with all applicable laws and regulations
• Be present at the delivery address during the agreed delivery window
• Pay all charges associated with your orders in a timely manner

You are responsible for all activities that occur under your account and for maintaining the security of your account information.

Orders and Payment

All orders are subject to acceptance by mythicerwt. We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in pricing or product information, or suspected fraudulent activity.

Prices for our services are quoted in Euros (EUR) and are subject to change without notice. Payment is due at the time of order placement unless otherwise agreed. We accept various payment methods as indicated during the ordering process.

If payment is not received or is declined, we reserve the right to cancel your order and may suspend access to our services until payment issues are resolved.

Delivery Terms

Delivery times are estimates and may vary due to factors beyond our control, including weather conditions, traffic, or high demand. While we strive to meet estimated delivery times, we cannot guarantee exact delivery times.

You must be available to receive your order at the specified delivery address during the agreed delivery window. If you are not available, additional charges may apply for redelivery attempts.

Risk of loss and title to food items pass to you upon delivery. You are responsible for inspecting your order upon delivery and reporting any issues immediately.

Cancellation and Refunds

Orders may be cancelled up to one hour before the scheduled delivery time. Cancellations made within one hour of delivery may be subject to a cancellation fee. For event catering orders, different cancellation terms may apply.

Refunds will be processed according to our refund policy and may take 5-10 business days to appear in your account. We reserve the right to refuse refunds for orders that have been delivered according to your specifications.

Intellectual Property

All content on our website and in our services, including but not limited to text, graphics, logos, images, software, and other materials, is the property of mythicerwt or our licensors and is protected by Dutch and international copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, or transmit any of our content without our prior written consent, except as permitted by applicable law or as expressly provided in these Terms.

The mythicerwt name, logo, and all related marks are trademarks of mythicerwt B.V. You may not use these marks without our prior written permission.

Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our services, you consent to the collection and use of your information as described in our Privacy Policy.

Limitation of Liability

To the fullest extent permitted by applicable law, mythicerwt shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of our services.

Our total liability to you for all claims arising from or related to these Terms or our services shall not exceed the amount you paid to mythicerwt in the twelve months preceding the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you. In such cases, our liability will be limited to the fullest extent permitted by applicable law.

Food Safety and Allergies

While we take food safety seriously and work with reputable suppliers, you acknowledge that food preparation and delivery involve inherent risks. You are responsible for informing us of any food allergies or dietary restrictions when placing your order.

We cannot guarantee that our food preparation areas are completely free from allergens. If you have severe allergies, please consult with us before placing an order and consider whether our services are appropriate for your needs.

Force Majeure

mythicerwt shall not be liable for any failure or delay in performance of our obligations under these Terms if such failure or delay results from circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labour disputes, or government actions.

Termination

Either party may terminate this agreement at any time with or without cause. mythicerwt reserves the right to suspend or terminate your access to our services immediately, without prior notice, if you breach these Terms or engage in conduct that we determine to be harmful to our business or other users.

Upon termination, your right to use our services will cease immediately. All provisions of these Terms that by their nature should survive termination shall survive, including but not limited to intellectual property provisions, disclaimer of warranties, and limitation of liability.

Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law principles. Any disputes arising from or relating to these Terms or our services shall be subject to the exclusive jurisdiction of the courts of the Netherlands.

If you are a consumer resident in the European Union, you may also bring proceedings in the courts of your country of residence, and nothing in these Terms affects your rights as a consumer under applicable EU consumer protection laws.

Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of our services after such changes constitutes your acceptance of the new Terms.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published by mythicerwt, constitute the entire agreement between you and mythicerwt regarding your use of our services and supersede all prior agreements and understandings.
